The use and distribution of marijuana is regulated by both state and federal law. Possession of marijuana is a criminal offense and penalties depend on the amount.

  • If you posses concentrated cannabis which is the separated resin, you can have a fine of up to $500, up to one year in jail or both.
  • If you have less than 28.5 grams, it’s an infraction and punishable by a fine of up to $100.
  • If you have more than 28.5 grams you can be fined up to $500 and have to serve in jail for up to 6 months.

In California, a business may sell drug paraphernalia, as long as such sales are handled according to specific regulations.

  • For example, a business must display and sell drug paraphernalia in a completely separate room where people younger than 18 are excluded unless accompanied by a parent or legal guardian.
  • Each entrance to a room must be clearly marked with a sign stating that paraphernalia is kept inside and that minors are not allowed without a parent or guardian.

It is illegal for a business owner to permit someone younger than 18 to enter or remain in an area where paraphernalia is sold without a parent or guardian.

These regulations do not apply to pharmacists who sell or furnish paraphernalia. It also does not apply to a manufacturer, wholesaler, or retailer licensed by the California State Board of Pharmacy. Operating a business in violation of these regulations is grounds for revocation or nonrenewal of any license or permit.
