Expungements, Pardons & Certificates of Rehabilitation
Having a criminal record can have severe consequences on your life and push you back in a variety of ways such as finding jobs or renting an apartment. If you have a criminal record, in some cases you could get your arrest or conviction expunged from your record. Make sure you contact an experienced attorney who can explain to you the process and whether you qualify.
The process of expunging or clearing a criminal record is usually called “dismissal”. Once it’s expunged, your conviction is entirely erased, as though you never committed the crime. And you won’t have to disclose that you were convicted. It is illegal for most employers in California to ask about an arrest that did not result in a conviction.
If you’ve received a probation, a fine or served county jail, you can petition for a dismissal. Keep in mind your conviction will not be dismissed if you are currently charged with, on probation for, or serving a sentence for another offense. You are also not eligible for a dismissal if you have committed a sex crime against a minor or were sentenced to state prison or transferred to the authority of the California Department of Corrections and Rehabilitation. In such circumstances, you can request a Certification of Rehabilitation.
You can petition for dismissal in the following circumstances: if you have completed probation or obtained early release; if you were convicted of an infraction or misdemeanor and never received probation; you were convicted of a felony and you have completed probation or county jail time; you were convicted of another offense and the court agreed to dismiss it; you have completed a diversion program; or you were charged with possession of marijuana. Make sure to contact an experienced Sacramento criminal defense lawyer who can help you specifically.
