  • According to Section 264, rape involving a minor under the age of 14 is punishable by a term of up to 13 years. Aggravated sexual assault of a child carries a sentence of 15 years to life.
  • The Penal Code likewise prohibits “unlawful sexual intercourse, sexual penetration, oral copulation, or sodomy” where “consent is procured by false or fraudulent representation with intent to create fear.”

California criminal law requires people convicted of a misdemeanor or felony sex offense to register as sex offenders. Sexually violent predators who reside in a state mental health facility and are undergoing treatment must also register. Registered sex offenders are also required to provide authorities with a DNA sample or face a separate criminal charge punishable by either a fine or a one-year jail sentence.
