Bail is some form of property deposited or pledged to a course to persuade it to release a suspect from jail on the understanding that the suspect will return for trial or forfeit the bail. In some cases, bail money may be returned at the end of the trial, if all court appearances are made regardless of whether the person is found guilty or not. If a bondsman is used and a surety bond has been obtained, the fee for that bond is the fee for the insurance policy and is not refundable. The person that releases the suspect out of jail becomes responsible for his or her appearance at the time and place designated.
Not all criminal charges are subject to right to bail, such as murder. Misdemeanor charges usually have lower bail amounts than felony cases. Either the defendant cannot post bail and must remain in custody until the conclusion of the case or the sentence imposed. The alternative to using a bail bond agent is to pay directly to the jail the entire amount of the bail in cash or cash equivalent plus a processing fee.
